According to DCP (PRO) Suman Nalwa, Moitra has been charged under Section 79 of the Bharatiya Nyay Sanhita (BNS), which deals with work, gestures, or acts intended to offend women’s modesty.
Mahua Moitra, a TMC MP from Krishnanagar, was the target of a formal complaint filed on Sunday by the Delhi Police’s IFSO unit for her comments made against Rekha Sharma, the head of the National Commission of Women.

According to DCP (PRO) Suman Nalwa, Moitra has been charged under Section 79 of the Bharatiya Nyay Sanhita (BNS), which deals with work, gestures, or acts intended to offend women’s modesty.
Prior to this, NCW had filed a formal complaint against Moitra after taking suo motu notice of her comments. Moitra uploaded a video on X on July 4th, which showed Sharma arriving at the scene of the stampede in Hathras. The video was then removed.
The image in the tweet shows a man following Sharma while clutching an umbrella.

The NCW stated in a post on X that “a detailed action report should be communicated to the Commission within 3 days and a FIR should be registered against Moitra.”
“The crude remarks made by Moitra are extremely outrageous and a sheer violation of a women’s right to live with dignity,” the NCW had said in its complaint.
Responding to NCW’s post, Moitra wrote: “Come on Delhi Police please take action immediately on suo motu orders. Am in Nadia in case you need me in next 3 days to make a quick arrest. I Can Hold My Own Umbrella .”
